Terms of Service
These terms apply to your use of dovtail.app and to services provided by Dovtail Records Management, LLC, a Texas limited liability company ("Dovtail"). By using the site or our services, you agree to them. Specific projects may also be covered by a written proposal or agreement, which controls if it conflicts with these terms.
Our services
Dovtail provides record management software, record digitizing, purchase integrations, and custom websites for places of remembrance. Scope, deliverables, and fees for each engagement are described in a written quote or agreement.
Your responsibilities
- Provide accurate information and the materials we need to perform the work.
- Make sure you have the right to share any records you give us.
- Keep your account credentials confidential and use the services lawfully.
Fees and payment
Dovtail is offered as an annual subscription. Fees are stated in the applicable quote or agreement, are billed annually in advance, and renew each year unless cancelled. Website building, digitizing, and onboarding are charged separately as one-time services, as stated in your quote. Payments are processed by Stripe. See our Refund & Cancellation Policy.
Your data
You keep ownership of the records you give us. You grant Dovtail permission to host, process, and display them as needed to provide the services. See our Privacy Policy.
Our intellectual property
Dovtail and its licensors own the software, site, and branding. We grant you a limited, non-exclusive right to use the services for your internal operations while your agreement is active.
Disclaimers and limits
The services are provided "as is" to the extent permitted by law. Dovtail is not liable for indirect or consequential damages, and our total liability for any claim is limited to the fees you paid us for the services in the 12 months before the claim.
Termination
Either party may end an engagement as described in the applicable agreement. We may suspend access for misuse or non-payment.
Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
